Terms of Service

Agreement and eligibility

You accept these terms and the Terms of Use electronically when purchasing or activating paid access through a process that presents them and asks you to agree. No paper signature is required. You are the purchaser unless the account and order identify a separate organization for which you have authority to purchase. The checkout and order state the plan, price, currency, applicable tax, monthly billing period, renewal status and included limits. No fee, automatic renewal or optional charge applies unless disclosed and accepted. Viewing a public player page alone does not purchase a service plan.

The accepted order controls your plan, price and included limits. The Terms of Use and Subscription and Refund Policy supplement these terms; their main conduct and billing rules also appear below. Any applicable Data Processing Agreement controls processing performed on your behalf and takes priority on that subject. Related documents must be presented before you accept them. The Privacy Policy explains personal data handling and is not blanket consent to unrelated processing.

Account access and security

We grant you a limited right to use the purchased service during the subscription term for your authorized communities and servers. You must be an adult with legal capacity to purchase. Keep account credentials, server access and API keys secure; grant only necessary permissions and promptly remove access that is no longer authorized. Tell us about suspected compromise.

Community responsibilities and permitted use

You must have permission to connect each server and submit or process its information. You remain responsible for your community rules, staff instructions, notices to players, moderation decisions and selection of integrations. Publish a player-facing privacy notice before using player monitoring or shared moderation. Players must direct moderation appeals to the community that issued the decision; War Guardian does not decide community appeals. A shared ban does not authorize harassment or public allegations.

Use the service only for servers and information you are authorized to administer or review. Follow assigned permissions, relevant game and platform rules, and the service limits. Keep review conclusions tied to their evidence, sample period and limitations.

Do not bypass access controls, misuse another person's credentials, access another community without authorization, extract restricted personal data or expose private evidence. Do not submit fabricated records, falsify ban reasons, impersonate staff, harass players, publish personal details to intimidate them, or use the service for unlawful discrimination.

Do not upload illegal content, malware or irrelevant sensitive personal information. Do not disrupt service through abusive traffic, unauthorized scanning or excessive scraping. Model fitting is limited to WarGuardian's local detection use described in the Privacy Policy and Data Processing Agreement. Do not train LLMs or general-purpose models on player data. Do not permit external AI providers to train on submitted data. Do not use anonymous cold storage for model training. Do not attempt to identify people from anonymous archives.

Monthly billing and renewal

Checkout states the plan, monthly price, currency, taxes, included limits, any trial, renewal terms and cancellation method before payment. Stripe handles payments under its applicable terms and privacy policy at https://stripe.com/privacy. We provide an order confirmation. You are responsible for accurate billing information.

Your subscription renews monthly only if automatic renewal has been clearly disclosed and accepted before payment.

We provide legally required renewal reminders and cancellation opportunities. Price increases require appropriate notice and authorization and do not apply retroactively. A trial converts to a paid plan only with clear advance disclosure and valid authorization.

AI providers, game hosting and other services you contract with separately may impose their own charges. A War Guardian request limit is not necessarily an AI spending cap. We obtain required authorization before changing the price or introducing charges.

Cancellation

A subscription renews monthly only if disclosed and accepted. Cancel future renewal through War Guardian subscription settings or the Stripe billing portal available from the service. If those routes are unavailable, email [email protected] from your billing email with your order or account reference. Cancellation takes effect for the next renewal; access continues through the paid period. We confirm the final access date.

Seven day first purchase refund

If the service is not right for you, request a full refund of your first monthly subscription purchase within seven days of purchase. Include your order reference and a brief reason; no supporting evidence is required. This voluntary guarantee covers the first subscription purchase only, excluding renewals, upgrades and later purchases. After seven days, payments are non-refundable except as stated below or required by law.

We refund duplicate or erroneous charges and agreed credits. If we discontinue a prepaid service or a material unresolved failure requires termination, we refund unused prepaid fees where these terms or law require it. Cancelling renewal alone does not create a refund entitlement. Statutory withdrawal, refund and other consumer rights take priority, including any longer cancellation period.

Email refund requests to [email protected]. Approved refunds go to the original payment method without undue delay and within applicable legal deadlines; Stripe may take additional time to display the credit. No waiver of legal or privacy rights is required.

Consumer withdrawal and payment failures

Monthly billing or immediate access does not automatically remove applicable consumer cooling-off rights. Any required request to start service early and explanation of lawful deductions must be obtained separately.

If payment fails, we notify the billing contact and allow a reasonable opportunity to resolve it before ordinary suspension. We may act sooner for fraud or serious security risk. Ending War Guardian does not end a separate game server or AI provider agreement.

Customer content and personal data

You retain any rights you hold in submitted records, evidence and community content. You give us the limited permission needed to host, process, transmit and return that content to provide the agreed service and carry out your lawful instructions. This permission does not transfer ownership. Model fitting is limited to WarGuardian's local detection use described in the Privacy Policy and Data Processing Agreement.

You may submit content only with the rights and lawful basis needed for its use. Do not submit unrelated sensitive information or evidence obtained through unlawful intrusion. We may fit local detection models to recorded gameplay statistics solely to support manual anti-cheat review. This permission excludes uploaded evidence, messages, saved AI summaries, Steam profile information and anonymous cold storage. We do not train LLMs or general-purpose models on player data or permit external AI provider training. Creating anonymized kill feed cold storage from processor-held records requires your documented authorization and the safeguards in the Data Retention and Cold Storage Policy. Steam profile information is excluded from that archive.

The Privacy Policy explains what we collect, how information is used and shared, and how to exercise applicable privacy rights. Privacy requests remain available after cancellation, suspension or a community ban. Contact [email protected]. Any applicable Data Processing Agreement is accepted electronically with the service terms; no separate paper signature is required.

Kill feed retention and ban record deletion

Communities can access kill feed records for 180 days from each event, subject to subscription and authorized access. After 180 days, the records are anonymized and retained in cold storage on a lifetime basis, with no fixed expiry. That archive contains only anonymous kill feed data and derived statistics; it excludes Steam profile information, ban records and evidence, and preserves no means to reconnect events to player accounts.

Ban records and their associated reasons, notes, review decisions, evidence and attachments are retained for 180 days from ban record creation, then deleted without anonymization or lifetime storage. Adding evidence does not restart that period. Earlier valid deletion requests, applicable end-of-service requirements and specific documented legal holds are addressed in the Data Retention and Cold Storage Policy. Backup copies follow its separate isolation and expiry requirements.

By accepting the applicable Data Processing Agreement, you expressly instruct us to prepare the anonymized kill feed archive under these safeguards. No archive instruction authorizes model training or overrides applicable privacy rights.

External services and review tools

War Guardian relies on game servers, Discord, Steam, hosting services and enabled third-party integrations. Availability and data accuracy may be affected by those services, interruptions or incomplete collection. Features and plan limits are those stated in the accepted order. Any service level guarantee must be expressly included in that order.

Player measurements, relationship inferences, alerts and AI summaries support investigation. They can reflect missing data or errors and do not establish cheating. You must independently assess evidence. We do not promise detection of all misconduct or prevention of every false positive.

War Guardian uses service providers for hosting and storage, with primary service hosting in the United States. Stripe handles payments. Steam profile information is obtained through permitted Steam interfaces under applicable Steam policies. Third-party providers have their own terms and privacy arrangements; the supplier register describes the relevant recipients and locations.

Suspension and termination

We may restrict access to address nonpayment, a material breach, compromised access, unlawful use or a serious security risk. Where practicable, we explain the reason and allow a reasonable opportunity to resolve it. Immediate restriction may be necessary to contain an urgent risk. Any restriction must be proportionate and must not prevent privacy requests or lawful access to remedies.

You may cancel renewal as described in the Subscription and Refund Policy. Before ordinary termination, you may request an export of customer-controlled personal data that we are permitted to return. The retention policy and data processing agreement govern deletion, lawful holds and backup expiry. If we discontinue a prepaid service without a breach by you, we refund the unused prepaid portion.

Service and contract changes

We may make operational and security updates. For material contractual changes, we give at least 30 days' notice, except where a shorter period is necessary for a legal obligation or urgent security issue. Changes do not retroactively remove accrued rights. If a change materially reduces a prepaid service, you may cancel the affected service and request a proportionate refund, subject to any greater statutory rights.

Warranty disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS. EXCEPT FOR EXPRESS OBLIGATIONS IN THESE TERMS OR THE ACCEPTED ORDER, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE EXTENT THEY MAY LAWFULLY BE DISCLAIMED. We do not guarantee uninterrupted or error-free operation, complete or accurate records, detection of all misconduct, or any particular moderation outcome.

Liability and mandatory protections

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE EXCLUDE LIABILITY ARISING FROM OR RELATING TO THE SERVICE, INCLUDING LIABILITY FOR ORDINARY NEGLIGENCE. We exclude indirect, incidental, consequential, special, exemplary and punitive damages, and lost profits, revenue, goodwill, business opportunities or data, to the extent permitted by law, even if advised of their possibility. These exclusions apply regardless of whether a claim arises in contract, tort or another legal theory.

Where liability cannot lawfully be excluded but may lawfully be limited, our aggregate liability for related claims is limited to the subscription fees you paid us during the six months before the event giving rise to the claim. This cap does not apply to expressly promised refunds, mandatory consumer warranty remedies, or any other liability or remedy that cannot lawfully be limited.

Nothing in these terms excludes or limits liability for fraud, intentional harm, willful misconduct, gross negligence, death or personal injury where exclusion is prohibited, or any other liability that cannot lawfully be excluded or limited. Mandatory consumer warranties, statutory remedies and data protection rights remain available, as do refunds expressly promised in these terms. If an exclusion is unenforceable, it applies only to the extent the law permits.

Ownership

War Guardian and its licensors retain rights in the service software and branding. Third-party game, Discord and Steam marks remain their owners' property. No affiliation or endorsement is implied unless expressly stated.

Governing law and disputes

Contact [email protected] for service disputes. These terms are governed by the laws of Maryland, United States, except where mandatory law requires otherwise. To the extent legally permitted, disputes may be brought in competent state or federal courts in Maryland. Consumers retain any law and court protections that cannot be waived, including any right to bring a claim in another competent court. If a clause is unenforceable, the remaining terms continue to the extent legally possible.

Service continuity commitment

If WarGuardian permanently ceases operation, we will release all WarGuardian-owned code and models under open-source licenses.

The release will include scoring rules, model files, and training and evaluation code.

Private community and player data, credentials, and third-party material that we cannot redistribute will be excluded.

Existing refund and data export rights remain unchanged.
